Terms of Service

Welcome to CareGivFam. We built this private family circle to bring real peace of mind to caregivers and their loved ones. These Terms of Service (“Terms”) form a legal agreement between you and CareGivFam (“we,” “us,” or “our”). By creating an account, installing our PWA, or using any part of CareGivFam, you agree to these Terms. Please read them carefully.

1. Our Service

CareGivFam is a private web-based platform (PWA) that helps families coordinate care for an elder. Features include shared calendars, medication trackers, tasks, document storage, two separate chats (one visible to everyone, one visible only to family members), and an Elder view with a safety button. We are not a medical provider, doctor, or emergency service. Nothing on CareGivFam is medical advice. Always consult healthcare professionals for medical decisions.

2. Eligibility and Accounts

You must be at least 18 years old to use CareGivFam. You are responsible for keeping your account secure. Do not share login details. When you create a Care Circle, you choose roles: Admin, Member, or Elder. Elders have limited access by design—the private Care Team Chat is completely invisible to them. You agree to respect these role boundaries.

3. Your Responsibilities

You agree to:

• Use CareGivFam only for lawful, family-care purposes
• Keep all information in your circle accurate
• Respect every family member's dignity and privacy
• Not upload harmful, illegal, or abusive content in chats or documents
• Not use the service to harass, stalk, or harm anyone
• Immediately report any safety concerns via the emergency button or support

We may suspend or terminate accounts that violate these rules.

4. Content You Share

You own the content you upload (messages, photos, documents, etc.). By using CareGivFam, you give us a limited license to store, display, and process that content only to provide the service. We do not claim ownership of your family's private information.

5. Privacy

Your privacy is extremely important to us. Please read our Privacy Policy which explains how we collect, use, and protect your data. It is part of these Terms.

6. Payments and Subscriptions

• All paid plans are billed monthly or yearly through Stripe.
• One payer unlocks the chosen tier for the entire Care Circle.
• Prices are shown clearly before purchase.
• You can cancel anytime in your account settings. No refunds for partial months, but you keep access until the end of the paid period.
• We may change prices with notice.

7. Cancellation and Termination

You may delete your account or entire Care Circle at any time. Data is permanently deleted after 30 days. We may terminate or suspend access if you violate these Terms or for safety reasons.

8. Disclaimers

CareGivFam is provided “as is.” We do not guarantee that the service will be error-free, uninterrupted, or that every reminder will be received. The emergency button is a convenience tool only—not a replacement for calling 911. We are not liable for any medical outcomes, missed appointments, or family disagreements.

9. Limitation of Liability

To the fullest extent allowed by law, CareGivFam and its team will not be liable for any indirect, incidental, or consequential damages (including lost time, stress, or medical issues). Our total liability will never exceed the amount you paid us in the past 12 months.

10. Indemnification

You agree to protect and hold us harmless from any claims, losses, or costs arising from your use of the service, your content, or your violation of these Terms.

11. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of laws rules. Any disputes will be resolved in the courts of San Diego County, California.

12. Changes to These Terms

We may update these Terms. If the changes are material, we will notify you by email or in-app notice. Continued use after the effective date means you accept the new Terms.
